India Tightens Overseas Citizenship of India (OCI) Rules

Context:
 MHA issued a gazette notification tightening the grounds for cancellation of OCI registration, citing national interest, criminality, and compliance.

  • An OCI cardholder can now lose registration if sentenced to imprisonment for ≥2 years or charge-sheeted for an offence with punishment of ≥7 years.

  • Applies to convictions both inside and outside India, if offence is recognized by Indian law.

  • Existing grounds (Section 7D, Citizenship Act 1955) also cover fraud, false representation, disaffection to Constitution, unlawful trade with enemies in war, conviction post-registration, and threats to sovereignty, security, or foreign relations.

  • OCI scheme (since 2005): Lifelong visa, multiple entry privileges for foreign nationals of Indian origin, but not available to those with Pakistani/Bangladeshi lineage.
